South Lake Tahoe City Council meeting Tuesday

SOUTH LAKE TAHOE, Calif. - City Council will be holding their next meeting on Tuesday September 22 at 9:00 a.m.

The agenda is a fairly short one with the last two regular council meetings lasting about eight hours each.

There will be a closed session meeting at 8:30 a.m.

Council will consider postponing or canceling all City permitted special events until November 17, 2020 or until public health officials deem it is safe to gather in larger groups. All permitted special events have been canceled since May 12, 2020, due to the pandemic.

They will also hear about a possible plan to abandon the Riverside Drive Public Right-of-Way Easement. In 2009 the City conditionally abandoned the portion of Riverside between Lakeview Avenue and Lake Tahoe.

Conditions of the abandonment of public right-of-way required the applicants to record a 10-foot wide public access easement to the Lake and construct a five-foot wide paved pedestrian trail to the bluff overlooking Lake Tahoe. The conditioned improvements were to also include a paved area and installation of a park bench. At the time, maintenance of the conditioned improvements was the applicant's responsibility.

A developer at the location, Tahoe Lakeview, was going to build a timeshare project but sold the property and development rights to the current developer, Nicksam Properties, LLC. The company and the adjacent neighbor to the west, Dr. Kevin Cassidy, are now requesting the City quit claim the easement, relieving them of the responsibility of constructing the conditioned improvements and performing maintenance responsibilities. The affected property owners have cited the proximity to Lakeview Commons as being adequate public access, noting the right-of-way and proposed public access between their properties provides minimal benefit to the public. There are now two new homes on the east side of the easement on the Nicksam property.

The Council can vote to accept the quit claim, deny it, or modify conditions of the 2009 resolution.
